Prenuptial Agreements for Sugar Land Couples: Protect What Stays Yours

In Texas, what you each earn after the wedding belongs to both of you. That can change if you agree otherwise in writing.

You need to know what a prenup can protect and whether it will hold up years from now. You also need a calm way to bring it up with your partner. A family law attorney in Sugar Land can help you do that.

At KGK Family Law, experienced attorneys Yasmin Kutty and Denise Khoury work hard to help couples enter agreements that make them comfortable now and confident about the future.

Contact us and let us know your wedding date and a rough list of what each of you owns. We will tell you what a prenup can cover and whether there is time to do it right.

Property, Debt, and Family Gifts a Texas Prenup Can Cover

A prenup lets you decide before the wedding what stays separate property and what becomes community property. Separate property belongs to one of you. Community property belongs to both. We write terms for situations like these:

  • Business ownership: We spell out whether a company you started or co-own stays yours alone.
  • Property bought before the wedding: A house, a car, or savings can be named as separate property.
  • Employer stock and retirement accounts: We set rules for stock grants and 401(k) balances that grow during the marriage.
  • Family gifts and heirlooms: We list gold, jewelry, inherited items, and property overseas one by one.
  • Debts: We spell out who is responsible for student loans, credit cards, and business debt.
  • Spousal support: We write terms on whether either of you will receive support if the marriage ends, within the limits Texas law allows.

Couples with a religious marriage contract should bring it to the first meeting so the two documents work together.

What Makes a Texas Prenup Hold Up and What Makes It Fall Apart?

A prenup does not work just because both of you signed it. A court can refuse to enforce it if:

  • One partner did not sign freely. The partner claiming this will need to prove it to the court.
  • The agreement was very unfair when it was signed. The spouse fighting it needs to prove three things. First, they did not get a fair and reasonable look at the other person’s property and debts. Second, they did not give up that right in writing. Third, they did not know, and could not reasonably have known, what the other person owned and owed ( Fam. Code Ann. § 4.006).

A prenup also cannot cut off a child’s right to support, so a clause that tries will not stand (Tex. Fam. Code Ann. § 4.003).

Two things help an agreement stand up: full financial disclosure from both partners and enough time to read the draft. We plan both into every prenup we write.

How a Prenup Gets Done Before the Wedding?

Your prenup moves through four steps, and we handle the paperwork at each one.

  1. Meet with us: Bring your wedding date and a rough list of your assets and debts.
  2. Share your finances: Each partner lists everything they own and owe, with statements to back it up.
  3. Go through the draft: Both sides trade edits until each of you understands every term.
  4. Sign with time to spare: Both of you sign well before the wedding. A signing the week of the ceremony can look rushed.

Start by sending us your wedding date, and we will work backward from there to set each deadline.

What Sugar Land Couples Ask Before Signing a Prenup

What should we bring to our first prenup meeting?

Bring your wedding date and a list of what each of you owns and owes. Think about bank accounts, real estate, and any business interests. Rough numbers are fine at the start. We sort out the details together.

Do we sign our prenup before or after we pick up our marriage license?

Either order works, as long as both of you sign before the ceremony, because a prenup takes effect when you marry.

Can a prenup decide child support or custody?

No. A prenup cannot reduce a child’s right to support. Courts also decide custody based on what is best for the child at that time, not on what parents wrote years before.

What happens if we do not have a prenup?

Texas rules fill in the gaps. What you each earn during the marriage belongs to both of you, and a court divides it in a way it considers fair if you divorce. Property you owned before the wedding usually stays yours, but you may need records to prove it.

Does a prenup protect an inheritance or a gift from a family member?

Inheritances and gifts to you alone are usually separate property even without a prenup. The trouble starts when the money gets mixed into a joint account. Then you may have to prove where it came from. A prenup lets you document those items before they mix.

Can we change our prenup after the wedding?

Yes, but only in writing, signed by both of you. We also write postnuptial agreements for couples who want to add terms after the wedding.

Does asking for a prenup mean we expect to divorce?

No. Couples use a prenup to talk through money before the wedding, while both of you are calm and on the same side. Share the first draft early and treat the signing as a planning step.

How much does a prenup cost for a Sugar Land couple?

The cost depends on how much each of you owns and how many terms need negotiating. A simple agreement costs less than one that covers a business or property overseas. Ask about fees at your consultation so you know the number before you hire us.
